Successful claim today but worried about forms signed 4 years ago

In August 2012 I signed up with Joshua Brookes to investigate 3 PPI mis-selling claims as I thought it was more complicated than it was. I think I signed the forms but I also recall telling them over the phone a few weeks later that I wasn't continuing with it and heard no more from them after that point. Because they were old loans/credit cards I thought the chances of being successful were very slim so was resigned to not getting anything back.

However when Martin's show once again covered it in January this year, I dug out the information I did have and sent off claims myself via Revolver. I was delighted to come home tonight to an offer from Santander of £5,500+.

So my question is do Joshua Brookes have any claim on this even though this clearly came from my own personal claim this year and they didn't do any work on my behalf. Are they likely to find out that I've been paid and demand a share?

    Depends what you signed.
  • I've just done a Google search and seems they went into Administration in September 2012. Can't find out any other information about them so am assuming they're no longer in business, at least not as I Want My PPI Back which is who I signed up with. So if they do try to claim from me I would think I have a case to say no?

    They went into administration in 2014 but it doesn't matter as they didn't make the complaint and as such couldn't charge you for doing so even if they were still trading.

    Thanks folks. I did sign the forms alas, which with hindsight was a foolish thing to do, but I wasn't aware it was so easy to do yourself at the time. I will pay the fee if they ask for it but it's just that having not heard anything from them in 4 years, I don't want them to then wait another few years before they ask for it. And obviously I don't want to just offer it to them with them having done no work for it. In the short term I will put the approximate amount of the fee away just in case.

    I've been in touch with the Legal Ombudsman and they said they do fall under their powers if I have a subsequent complaint about them. They've suggested I contact them and give them 8 weeks to respond. But it would make sense to wait for them to contact me first I think. So it's a case of waiting and seeing for now. If they write to asking for the fee I will write back and explain things and go from there.

  • You're right and I think I will contest it if/when it happens for that reason. Nevertheless I will set aside the money just in case I'm not successful in disputing it. I'm just worried that they'll leave it a few more years and then expect interest on top of it!

    They can't add interest, nor can they deliberately leave it a few years before billing you.

    If they really did not progress the original complaint, I don't see you owe them anything.
