due to get keys tomorrow but there's no gas safety certificate

Hi,

My and my girlfriend are due to move into a new house tomorrow, we're moving from renting 2 separate houses to 1 new rented house. We've allowed a few days overlap to allow time to move everything so we aren't due out of our respective houses until Saturday.

The letting agent rang earlier this afternoon to say the gas engineer has been today but can't issue a gas safety certificate as there is a panel missing from the boiler and due to the age of the boiler it might not be straight forward to replace, and asked if we can delay getting the keys tomorrow. I've said we have some time spare but need to be in on Saturday as we've given notice where we currently are and arranged removals etc.

The letting agent is going to ring later with an update but i'm wondering where we stand in terms of moving in tomorrow?

    technically it just means you cannot use the boiler

    Thanks, i was worried we weren't allowed to move in until the boiler was safe.

    Update, the letting agent has rung back and said he can't release the keys without a working gas certificate. The landlord has assured him that the boiler will be fixed on Friday, obviously i'm concerned that it won't be and therefore we won't be able to move in.

    The agent is wrong. Whether you can convince him of that is another matter.

    On a different note, it's good to see an agent concerned to do the right thing re safety.

    Of course, if your access IS delayed, make sure your tenancy start date (and hence rent payments) are amended to reflect this.

    You have a house that has had a gas safety inspection and that concluded some work needed to be done. You have an agent keen to do the right thing who clearly knows the implications of not having a valid gas certificate.

    If you have signed the tenancy I would ask the question of what the position is if the work is not done. Will they provide you with temporary accommodation? May be worth asking your current landlord tomorrow first thing if he has a tenant moving in tomorrow. If not might be willing to extend for a few days?
