Credit rating ruined by EE

Hi , i'm looking for some advice if possible please,
My contract with Orange came to an end beginning of last year and i cancelled my direct debit after they took the final payment. The phone was never used again and i never heard anything back from them after this.
Me and my partner are now looking at getting a mortgage so i went on to check my credit score and found out that they have put a severe unpaid penalty notice on my account and contacted deb collection agencies. The reason for this is that they charged my account for three months after the contract ended ?
As well as this i never received any remittance advise because they hadn't updated my address details when i requested they do it 6 months before my contract ended !
Obviously my credit score is now shot and have no chance of getting a mortgage i have called Orange offered to pay the bill which in itself is ridiculous but they would not change the credit score , is this just ruined for the next 6 years now ?

    What does your contract say about ending the agreement? It's common that once the contract comes to an end you go on to a rolling month by month contract and you have to tell them you want to end it.

    You need to dig out your contract and tell us what it says.

    Did you cancel your contract? Mobile phone contracts don't just end, you need to give notice.

    Yet another example of the malfunctioning credit reporting system. It's high time someone took this type of thing to their MP. Misunderstandings and mistakes, on both sides, are legion in the world of complicated phone contracts. The upshot seems to be all too often the customer is credit blacklisted and can't get a mortgage. A ridiculous state of affairs.


    OP tell the phone provider you'll pay what's owed, if anything, only if they'll take you off the blacklist. However, if you don't owe anything, then compensation should be coming your way.

    Nope, an example of someone not reading the terms and conditions. You don't end a contract just by cancelling a DD, if OP confirmed with EE that the contract was over and received it in writing, yes they'd have a case. If they simply cancelled the DD then they're in breach of contract which is exactly what the CRA should be reporting so other lenders can be made aware of past behaviour

    1 Yes your score has been ruined but only you can see it, lenders see the history.

    2 As been asked how did you cancel as you have to give 30 days either on the phone or by post.

    If you didnt cancel the contract as mentioned then the default stays since you broke the contract.

    As Bogalot has stated phone contracts are minimum term then go on a rolling month contract, you have to give notice to cancel direct to Orange and not via your bank by cancelling a DD. If notice wasn't given then the payment markers are factually correct. Paying to get the account settled is a must so the account shows as settled but it will be at the discretion of Orange if they remove any late payments / defaults on the account.

    8. Ending this Agreement
    You can phone Us and give 30 days’ notice to end this Agreement. Unless We tell You otherwise You will have to pay a charge for ending the Agreement before the end of the Minimum Term which We call the Cancellation Charge. The Cancellation Charge is the total of the Monthly Charges for the remainder of the Minimum Term, less any discount You are entitled to. If You end this Agreement after the end of the Minimum Term You will have to pay Charges during the 30 days’ notice period (see points 8.1, 8.2 and 8.3 of the terms and conditions).

    I didn't need to read past the first sentence. This is what happens when you cancel a mobile contract DD. I don't think you have a case to have it removed unfortunatly.

    As others have said, your contract must be cancelled verbally or in writing by giving 30 days notice, it's a common misconception that canceling the DD cancels the contract, it does not !!

    Also there is no physical contract either, use of the phone or sim, constitutes acceptance of the 24 month contract terms and conditions.

    Having said that EE/orange customer services is abysmal, there is very little effort put into chasing unpaid debts, they engage a DCA pretty quickly, and there complaints handling is also abysmal, complaints are regularly ignored.

    I would put this down to experiance OP.

    Rather melodramatic there Ginger.

    Can you point to any mobile provider that has a 100 page terms and conditions, or anywhere that the provider has not stuck to their side of the agreement?
