Sold a defective Secondhand van

We bought a secondhand van in November last year since then we have had to to a lot of work on the van to keep it going. On checking the mot history on line there was an mot on the van in February 2016 and the next one was due in February this year, however the previous owners had an mot in October 2016 which failed due to lots of things wrong. The mot was not put through again and the owner sold us the van knowing that there were serious faults. Where do we stand.

    When you checked the vehicles history you would have seen the MOT failure items and known what to expect.

    You bought a van with a short MOT, always one to watch out for and inspect carefully.

    What age/price/apparent condition?
    Private sale? Caveat emptor, unless you can prove that the vendor lied. Even then, four-five months later, it's very unlikely you could prove anything.

    You had ample opportunity to check the MOT status before purchase.

    Its an offence to sell an unroadworthy vehicle. This applies to both private sellers and dealers.

    Depending what the MOT history says, you may be in a strong position to press for a refund.

    Its an offence to use an unroadworthy vehicle on the public road also.
    OPs been driving it for how long?
