I have received a ticket from myparkingcharge.co.uk who having read the newbies guide this company are part of the IPC trade body.

The driver parked after 6.30pm and thought that it would be ok the park on the site at this time.

So as it was their over site, can they fight/appeal this £60 rising to £100 invoice?

I have read the guide but it says appeal if it is unfair, and whilst £60 is ridiculous, the driver didn't take the time to look for and read signage.

Also I don't think there have been any errors in the letter or details - although they don't know who was driving.

Should the driver cough up or can they get out of it?

I appreciate everyone come to this forum is looking for their own solution but any advise greatly received.

edit the above post and remove all traces of who was driving

just say THE DRIVER blah blah

or dont you think the parking companies read forums and take screenshots ?

for IPC members the advice is simple

    appeal using the IPC template

then IGNORE for 6 years unless you get court papers

it is extremely unlikely that any appeal will be upheld, they routinely turn down appeals , as does the IAS too (no matter who the PPC is , they all do the same as there is no profit in allowing any appeal)

it is unlikely that you will get out of it

we would say fight , and only pay if a judge tells you to pay, within 6 years, but as an adult its your choice to make, not ours

the SUPREME COURT ruled 15 months ago that these charges are not "ridiculous" , so anything up to £100 is not deemed "unconcionable" , meaning it is an argument with no weight in law anymore

Search myparkingcharge.co.uk on the forum for other threads the same.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

So once I have sent an appeal letter then what happens if it is turned down? Will a judge ask for an increased payment?

I did do so but it was still unclear and I was advised to start my own thread. Any further advise Coupon-mad?

there is no doubt about it , its not IF its turned down , its WHEN its turned down , they have you on the hook and no amount of wriggling will throw the hook until they are satiated or a judge throws it out

if it eventually goes to court then yes a judge may allow an increased payment , within reason (typically around £175) , but it could be less and could be zero and you might win and claim up to about £90 yourself

    so its anyones guess

ps:- the driver needs to learn a lesson from this and never park without permission of a landowner or landholder or parking company, sometimes that means paying , you rarely get anything for free in this modern world, so assume you pay unless you dont have to, assume you need permission unless you are given it

One additional question, what is the benefit of the appeal as like you have said it will be rejected? How is this different from ignoring it completely?

because a judge will expect all parties (including the person being brought to court) to try to resolve the issues before they have to step in and deal with it like a headmaster should not be dealing with pupils with late homework , but will do so if called upon

so a judge would tend to favour a claimant if they said they had sent out numerous letters and the defendant had ignored them all , so it is expected that the person receiving the letters would at least query it if nothing else , usually denying the debt or require further clarifications
