ParkingEye PCN - in England but Scottish Resident

    Any comments on the email that I plan to send? Should I include my driving licence as proof of address?

  • I've just received the copy of the letter that was sent to my old address - it is a "letter before county court claim". It says that as the 28 day period to appeal to POPLA has now passed I must pay the £100 within 14 days - it is dated 22nd Feb.

    I have sent the email with my new address today, asking that they confirm receipt - do you think this will be enough so that I do not have to pay or will they chase again? I am worried if I let the 14 days pass that I will have a CCJ against my name.

    send the letter back , "not at this address , try XXX xxx scootland , first class with proof of posting PS , do NOT sign it!!


    when court papers arrive at the old address , send THEM back to the court not at this address , try XXX xxx scootland

    it is a "letter before county court claim".
    The problem you have is that unless you contact them, their system will grind on using the English address and you might find a CCJ registered in your name at that address.

    In a couple of weeks time, expect there to be a claim form sent to your old address. Make sure you get that and then Acknowledge. On it will be your address for service. Put in your Scottish address so the court's know where to send the next paperwork. Send a copy to ParkingEye.

    PE are likely to try to bounce you into the English system and you have to work to keep it out. Don't expect PE to help but make sure the Court does.

    It matters not whether you left the car or stayed in it, or whether the engine was running. It's still parking.

    There loads of appeal points you can use. Have a look at post 3 of the NEWBIES.

    You don't need evidence and you don't need to appeal.

    You need to just be alert to any letters now arriving to your old or new address. This is not something to appeal now and you live in Scotland so the very LAST thing to do is try to explain the circumstances and blab about who was driving!

    If they issue court papers now they now SHOULD come to your Scottish address and would be a matter to contend jurisdiction. As IamEmanresu says to expect:
    ...a claim form sent to your old address. Make sure you get that and then Acknowledge. On it will be your address for service. Put in your Scottish address so the court's know where to send the next paperwork. Send a copy to ParkingEye.

    You may find they stop now and just send daft debt collection letters to your Scottish address which you MUST completely ignore.
