The car is not as described. If the OP brought it because they want low emissions (for environment or health reasons) it may not be fit for purpose. If the software update reduces performance or increases maintenance costs, the same complaints may apply.

Bear in mind there is absolutely no evidence - nor, even, credible suggestion - that the issue in question affects the EU emissions testing. It is a US-market issue. The US market has very different, and MUCH more stringent, restrictions on oxides of nitrogen than the European market.0 -
I'll also add that VW, nor any other manufacturer AFAIK for that matter, have ever published NOx emission figures so I fail to see how someone can claim to have been mis-sold a car, or more accurately sold a car not "as described" when the figures where never there to influence a decision to buy in the first place.
Whether it be the CRA or SOGA, it's simply a non-starter I'm afraid to say.0
