    The loss would be reduced value of the car on the second hand market.

    The car is not as described. If the OP brought it because they want low emissions (for environment or health reasons) it may not be fit for purpose. If the software update reduces performance or increases maintenance costs, the same complaints may apply.

    The OP needs legal advice.

    Reduces values appears to be a non starter, Spotted any affected vehicle being sold below market value?

    They bought for low emissions, yet the emissions vary depending on how you drive and the drive cycle. Has anyone actually tested their cars to see what emissions its actually putting out?

    When did you buy the car? Was it before October 2015? If so, then it's not CRA15, but Sale of Goods Act 1979. Since the affected vehicles were model years 2008 to 2015, it's unlikely any would have been first registered after that date.
    4-the legal, no win no fee, type companies trying to sue are advising not to get the software updated as AUDI are offering-what should I do.
    That all depends on whether your primary aim is to have the issue resolved or to get some kind of financial recompense (minus the ambulance-chaser's cut).

    Bear in mind there is absolutely no evidence - nor, even, credible suggestion - that the issue in question affects the EU emissions testing. It is a US-market issue. The US market has very different, and MUCH more stringent, restrictions on oxides of nitrogen than the European market.

    I'll also add that VW, nor any other manufacturer AFAIK for that matter, have ever published NOx emission figures so I fail to see how someone can claim to have been mis-sold a car, or more accurately sold a car not "as described" when the figures where never there to influence a decision to buy in the first place.

    Whether it be the CRA or SOGA, it's simply a non-starter I'm afraid to say.
