Car Accident Own Fault What happens to my car ????

Hi can someone help me ?

I had a car accident last week which i drove in to the back of someone.

My car is now a write off and i am liable for the whole accident.

I now have paid the excess

I wanted to find out is my car which is now a write will I be able to keep it so I can repair it myself even though it was a own fault claim. DO I HAVE THE RIGHT?

If not whats is the process as fixing it myself will be cheap but insurance said it will now be a cat d due to costs of repair ?

HELP!!!

You can ask if you can retain the car but they'll pay out less. You need to phone your insurance company and ask them.

If it's going to be Cat D, then you might. But the final decision is in the hands of your insurance company. If you read your Ts & Cs, it may say something about what they'll do - it'll certainly say something about them retaining the right to decide.

You will almost certainly have to forego part of the payout as salvage value.

You might be able to buy it back, but often they have a deal with a salvage company.

    It's really not.

You refuse to hand the car over, there is nothing they can do about it, they will just recalculate their payout, they will try to arrange a collection, because they get a nice kick back, above savage value for letting it go for auction / parts, you just refuse.

It's your car until such a time that you cash any settlement, if you wish to retain it you can, whether the insurer will make it economically viable is a different matter, but most will let it go for 10 - 20% of the settlement amount.

You don't ask them, you tell them, "I'm keeping the car"

Really? So you will be cancelling your claim then Sir?

Policy terms state... Salvage will not be offered to the keeper unless it was an agreed value policy with salvage rights?

but if sir wishes to keep the car and cancel the claim he will be free to do whatever he pleases. No payout for the vehicle will be made though.

Payments to affected third party claimants will not be affected.

Policy could be something like that. Seen several threads where the insurer refused to offer the salvage.

I wonder if they could offer the salvage at the full retail value?

You're claiming off YOUR insurer, then you are contractually obliged to go with the Ts & Cs of the policy.
It's your car until such a time that you cash any settlement,

...and part of that settlement is that the car is no longer your property.

So - you agree to settle the claim OR you keep your bent car. Choose.

BTW, this is just a Cat D. How would your logic work if they said it was a Cat B?
