Claim Form received - no NTK, no LBA received before

    I have not addressed the part about that I did not let them know the vehicle was rented to which I dont know what to say because I did not receive NTK or LBA so when could I have done that? I could include this by repeating the above that nothing was received prior to Claim.
    I also did not address their WS part about Particulars of Claim where it is says that the Claim form at CCBC allows to add very little, Surely it would have alowed 5 more words describing breach terms. Should I point that out?
    Could not add anymore about the signs as could not go inside the car park since there is no access to public, just to residents at present. But the photos I made and Google maps do not correspond to the Site plan as much as it is visible that was provided (bird view with marking there the signs supposedly have been/are. The map not dated either. Is it worth adding?

    Yes, you can do. And you never needed to let them know the vehicle was hired, there's no reason you should have done.

    Good evening,
    me being a pest again:

    Would I need a "covering letter" for the included WS? Do I address it to the judge directly and would say
    "Dear Judge so and so". That totally does not sound right. Please help. :)

    As your WS includes lots of evidence and documents, case law referred to, you have to include that with it. So the best way to present it for the Judge is in a ring-binder, page numbered, with a contents page headed 'Witness statement and evidence - defendant - Mr xxxxxxx - claim number xxxxxxxx.

    WS first then evidence behind that, numbered to match where it is referred to in your WS.

    So your WS might say: POFA Schedule 4 (adduced as evidence - LGTH*/1) and later Certificate of Motor Insurance for the Defendant (LGTH/2) together with termination letter of the Defendant's insurance (LGTH/3) etc., including the 2015 Annual Report page from Henry Greenslade about keeper liability, and the Jopson case transcript, and any other evidence you are bringing on the day, has to be filed now. Take it in person to the Court before 1.45pm before the Court counter closes for that day.



    *the initials can be your own real initials, e.g. if you are David Beckham, your evidence numbering could be DB1, DB2, etc.




    Oh, and nothing as nice/heavy for the other side, and no postage. Email the stuff to them, maybe breaking it into 2 or 3 subsequent emails, with PDF attachments NOT links, so each document is served properly.

    And copy your other email addy in so you can prove sending and receipt of your emails and print that proof out to stop them saying they never received your WS. Put those prints in your own copy of your entire bundle to take on the day.
