Being devil's advocate, the council might argue there is no hazard, so long as it's not exhumed, in the same way that asbestos in artex or floor tiles isn't harmful unless abraded or drilled.0 -
If it asbestos then it is not a sealed source. That soil is classified as hazardous and under current regulations they, as the landowner, have a duty to remediate the hazard.0

The council got back to me and said they're going to clear it :T
I've no idea why they changed their minds now when they refused previously. Maybe it just depends on who you talk to. Anyway, I'm happy, and relieved. Thanks for all the advice here.0
