IAS - Appeal dismissed - what is the next step?

Hello everyone,

I appealed a PCN that I had in December to the IAS. The decision has just came back that the appeal has been dismissed and I was wondering if anyone has had a similar experience that could give me advice.

Here is my situation:

I paid the correct parking fee, but unfortunately when I placed it on my dash board, it must have fell so there was no proof that I had paid my ticket.

When appealed to the company that issued the PCN which was Euro Parking Services, they refused my appeal and stated that the charge of £60 was payable as I hadn't displayed it and advised that I taken the appeal further to the IAS.

I appealed to the IAS on the basis that:
1. I had paid my ticket
2. There was no adhesive provided with the ticket so I couldn't attach it to the windscreen to ensure it remained in view of inside the windscreen as the terms and conditions of the euro parking services stated.
3. It is clear that where a ticket is not attached to a dashboard or windscreen, that there is a significant chance that it may become dislodged by air movement/vibrations, etc.

The IAS dismissed my appeal and have stated that the PCN has been issued correctly and accordingly this appeal is dismissed.

I don't know what to do next or what I should be expecting next?
I really don't think I should have to pay the charge as I did display my ticket and when i shut the door the ticket was in windscreen.

Any advice would be much appreciated.

    you would have to argue it out in court, let a judge decide

    the PPC has 6 years to try a court case using MCOL

    Please can we ban the phrase ''what is the next step?'' on here? Where has this phrase come from so often; we never used to get this asked. Why does everyone think things are all done in steps and there must be a next one, even though in parking ticket cases the NEWBIES thread already tells everyone:

    - don't waste your time with IAS
    - ignore the letters that follow
    - but come back if a court claim arrives.

    Next step? dont know, is it a step, up down, or to the side?

    Have you at any point contacted the landowner/car park owner? if not why not?

    Understand that the IAS is a scam operated by Mr Bean and Mr Bean of Gladstones solicitors.

    They protect their own members and their business model is to extort money.

    Just ignore it, you will probably get very silly debt collectors which can only be described as low quality toilet paper ... ignore them

    You might even get a fake Gladstones letter used by the debt collector.
    This is a mickey mouse company .

    If in a few months you a get a court claim, everyone here can help

    In the meantime read up how the mickey mouse set up loses in court.

    There is always a next step, involve the media, Facebook, Twitter, your M.P., the CA, Trading Standards, local chamber of Commerce, Landowner, the courts, Uncle Tom Cobley, whatever seems appropriate.

    Kick up a fuss, cost them money.
    You never know how far you can go until you go too far.

    As you should have realised from the posts above and the Newbies thread you are now in a 6 year waiting game. During this time you will get letters from Debt Recovery Plus and then Gladstones. The money they claim will go up to £150, then they will offer you ~£125 to settle, then it goes back up to £150.

    When you get them, put them in a folder for safe keeping and you can ignore them as long as none of them are headed "Letter Before Claim" or "Letter Before Action" or you receive a MCOL (Money Claim On Line).

    When you get an LBC, LBA or MCOL then they have finally decided to try their luck in the Small Claims Court at which point you read the threads here on that and then re-start this thread asking for help which you will get to defend this. If you win you then pay nothing and this is finished with once and for all.

    In the meantime I agree with the Deep. Complain to the landowner, shop etc. where you got your ticket as if you were a genuine user of the facilities (e.g. a shopper) they may be able to cancel the ticket for you which means this is all over - you haven't said where you got the ticket yet.

    You can tell the parking company that you are rejecting the result of the IAS appeal, as they have failed to comply with the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015 , and you have become aware that the IPC (trade association) the IAS ( so called appeals service) and Gladstones Solicitors, who pursue unpaid parking charges from IPC members all share the same directors, Namely Will Hurley and John Davies.

    As Will Hurley and John Davies have an interest in the Trade association, the so called independent Appeals service, and Gladstones Solicitors, any so called appeal using the IAS can not be independant by any stretch of the imagination.

    You should request that, under the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015 you have a right to an independent and transparent appeals service for upto 12 months after the event.

    You must also contact the landowner, and let them know just what their agents are upto on their land and on their behalf as well,. as the landowner is jointly and severely liable for the actions of their agents, and could be liable for any harassment caused as well as any possible breaches of the data protection act

  • @Half_way I haven't contacted the land owner, in all honesty I don't know how to find/access that information. Also, do you think I should email what you have said about them all being under the same directors to the Euro Parking Services?
