Soon to start divorce proceedings. I understand that whoever has the children living with them can apply for tax credits. What happens if the children are split exactly 50/50, can both claim or neither? Tia.

Whoever is claiming the child benefit will claim the tax credits as well. These can only be claimed once per child so you need to decide between the two of you who will be claiming them.0

I suppose (as you mention childREN) if it was split 50/50 then each of you could claim child benefit (and then tax credits) for 1 (or more) child0

Thank you both, that's helpful.0
