HighView Parking - Help Please [difficult situation]

Hello,

someone very close to me received two "invoices" from Highview parking (bpa member), now debt collectors stage, as far as im aware, unless there is any other letters that have been thrown away.
The problem is that this person is in hospital under section 2 mental health act, it is difficult to find out how it was possible to stay 6 hours in the parking for a small shopping center. another one from same company, different day - arrival at 2:30am leaving at 4:52 over stay im guessing, at a parking at wembley stadium.
we only opened the letters recently, to see what the problem was and we found many fines, also from councils.
I have a letter from the hospital to confirm the problem with this close person, but i don't know how to bite this., and what to do for him not to pay if they freeze this for now?

    unless HIGHVIEW were to issue court proceedings via Northampton , there is nothing to do apart from try and get the landholder to cancel the charges

    the BMPA zendesk will tell you how many court cases highview have issued

    debt collector letters for private parking charges can be IGNORED, they have no powers and can only issue bog paper , nothing more

    file the DCA letters and totally IGNORE them like the NEWBIES sticky thread tells you to

    its an official LBC or an MCOL you would need to try to deal with , perhaps if the person dealing with those letters had POWER OF ATTORNEY or whatever they call it when they are the legal person dealing with another persons affairs (because clearly the mentally ill cannot) then they should be acting on behalf of the disabled person

    the council ones are a different ball game

    CM may offer you advice on these issues as she knows a lot about them

    I would try Savills, they often manage shopping centres.

    The good news is Highview never sue and do not use the POFA so can't hold a keeper liable.

  • they dont know who the driver is as that is what it says on the letters, so i should not say riht?

    do you think they can freeze the chare for now ??

    Freeze the charge?
    How do you freeze a charge that in real terms is £0
    Follow the advice on here, do not panic, don't do anything rash, and no money will flow into the parking company.
    From the Plain Language Commission:

    correct, they may try to phish for driver details , do not give them those details

    they can put whatever charge they like up to say £5000 on paper

    its proving the charge to a judge that is their hard task, until then it is merely an invoice with words and numbers on it , its not real money and its currently £0.00p

    if it ever went to court and you lost the judge would put a figure on it, this is what you would pay which is typically about £175 , however , if you win then you can charge up to say £95 in costs and expenses , meaning the claimant would have to pay you instead

    so its not real unless a court says its real (a judge in the small claims court) - the small claims court only allows for limited costs , so no point worrying about money unless a judge tells you its £xx.xx and must be paid within 28 days

    if it never goes to court, then nothing is payable

    I could tell you that you owe me £100 for reading this reply, but actually extorting the money from your wallet would be a much harder task ;)

    @OP - please stop worrying, this is only Highview, a limp-waisted outfit who rely entirely on people being harassed via letters into paying them. They have never been anywhere near a court. We'll look after you.

    lol , like DRP and ZENITH and ZZPS I have found that people are ignoring my paper based threats and made up figures and its difficult to enforce an alleged debt without paying to go to the small claims court, then I have to pay a further fee and turn up in court and argue with a judge that my charges were justified and lawful and its a lot of WRIGHT HASSALL in doing all this when it costs more money than I get back !!! lol :)

    its even worse when these defendants deny being the perpetrator and my paperwork does not follow POFA2012 and my burden of proof and inflated charges are thrown out of court as being absurd
