Default date help

I was hoping some one could help.. I had a default registered against me on 12/07/13 for Orange, this debt has since been sold on to Lowell. After speaking with orange numerous times they finally found my account and the last payment I made was 02/01/13 before the default notice was put on in the July .

I might be clutching at straws but shouldn't the default date be 01/07/13 and is this grounds for getting the default removed?

Also they have no evidence of the default notice and have very little info about my account. I was told by their customer service that not to call up as no would entertain me like he had (this was the one who couldn't find my account and said I was wasting my time) :mad:

I have spoken with Lowell and even though the default is in their name they did not register it and they said they would need proof from Orange to confirm the wrong date had been entered (even though it was only 12 days late in registered)

Any advice would be much appreciated x

    At best you can have the date of default changed, but not removed. You could offer Lowell to for example settle the account if they will put the default date to earliest possible one.

    It would only be 12 days earlier though. Do they not have an obligation to register the default within 6 months of the last payment made? What happens if they register the default after this date? I don't know what the rules are with defaults

    There are no strict rules, just guidelines. You can negotiate to have it moved all the way back to your last payment, still will be fair.

    Arr that's a shame! I was sure I had read that it had to been issued up to 6 months after late payment :(

    As for the default notice and that they have no record of it does that make a difference?

    What type of difference would you like it to make? This isn't the movies where you get scot-free from a situation because some paperwork had a word misspelled.
