Failed Delivery & Previously Used Goods

Anyone help!!
Placed an order for a TV with a well known retailer 10 days ago which was due to be delivered a week ago. This failed to arrive so I called them the next day and was told it was an issue on their side and the order did not process correctly. This was after my wife had the original delivery date as a holiday from work. I was told to place the order again for delivery today. This time it arrived however, it can be clearly seen the box has been opened and had a previous delivery label on it. There has been no effort to disguise this fact. So I called them explained my dissatisfaction for a second time. They said after being kept on hold to take pictures of the box send them to customer services to verify and they will be in contact. Just done this now and await a reply. They have mentioned there will be a 'goodwill gesture' once I am happy with order and they might if the item I do want is not in stock meet the cost difference of something higher.
My question is what are my full rights and what should I push for given the above? I still want to keep the order with them for a variety of reasons but am without a TV on our lounge as this was a replacement. Any ideas suggestions etc particularly around my consumer rights gratefully received.
