    Very true, it could have already been there. That doesn't mean the garage knew about it. I mean, cars aren't sentient. They don't say "excuse me Mr. Garageman, I have a brake leak". They probably took it in part ex. Gave it a clean, valet, a quick spin around the block, perhaps a quick oil change and decided it was perfectly okay..... and to be honest, it's harsh to put all the blame onto them.
