Can I reclaim bank charges for someone who has died?

Hiya,

My poor mum was charged ridiculous amounts in charges by HSBC, she struggled so much after my dad died to bring us all up.

She too sadly passed away in 2012; I'm convinced it was through stress. She was only 55.

I know she started a claim through a middle man (key point) as there are numerous letters from them which I still have. I'm wondering if the banks have actually paid this company but they've kept the money.

Does anyone please have any advice for me. I would appreciate it greatly xx

    Bank charges are not recoverable even by people who are living (apart from those in current financial hardship) so you won't be getting any refunds on her behalf I'm afraid.

    Your Mother's engagement of a Claim Company would have been fruitless once the Banks won their court case in 2009. I'm assuming the letters are from a time prior to this.

    Even if a claim had been successful, though, the Bank would have paid any refund direct to your Mother who would then have been presented with a bill by the Claim Company. So no money will have been misappropriated.

    Time to put those old letters in the Recycle bin.

    EDITED TO ADD:

    One avenue you might wish to explore is a PPI mis-selling complaint on behalf of your Mother. There are no guarantees, but if you have documentary evidence of her having had the insurance (from her archive), then you can benefit from a successful complaint. Do note that you'd need valid mis-selling reasons.
