Draft Particulars of Claim - Civil Enforcement

Hi, I would appreciate some advice please. I am a nurse at a hospital where Civil Enforcement manage the car parks. I have a parking permit that I pay for on a monthly basis which allows me to park in designated staff car parks. In September I was involved in a RTA which resulted in me using a courtesy car for a number of weeks. I parked in the staff car park, which unbeknown to me operated using had number plate recognition. I had left a note informing usual parking attendant that this was in fact a courtesy car and details of permit. This resulted in a parking fine being sent to Enterprise Car Hire as the registered keeper. Enterprise then contacted me with details of the fine. I misread the letter, believing it to have read that they would pay the fine automatically as they held my card details. I received further paperwork from Civil Enforcement which I then appealed the fine based on my belief this had been paid. On Friday I received draft particulars of claim in the post. I contacted Enterprise to get confirmation of payment only to be told it was their admin fee which had been paid for me incurring the fine, not the fine itself. I am now at a loss as to what to do next. Many of my colleagues have received parking fines which they tend to be in the mindset of ignoring, however I am not aware of anyone having received Draft Particulars of Claim. can anyone offer some advice please? 😡

    Did you say who was driving...please don't do that in appeals v CEL! And no, the hire firm had NOT given your name as driver, only as hirer, a position which would have been easier to defend from.

    But you are an admitted driver, yes?

    Did you know the Hospital is breaching the will of Government by allowing CEL in? And that THEY remain liable for the actions of CEL?

    Read all of the above information and links. Complain to the Facilities Manager to get this cancelled, especially as you had a verbal contract and had done what was required:
    ''I had left a note informing usual parking attendant that this was in fact a courtesy car and details of permit.''

    If this is only a draft claim use this time to complain and get the NHS Trust to cancel it NOW before you are sued. These cases are defendable, however.

  • Thank you for your reply. I have read the information provided, which is very interesting. Yes I had admitted using the car. I will contact Facilities Manager and hopefully bring this matter to a close. If facilities aren't willing to offer any support I will repost for further advice. Appalled the Trust would allow for this kind of company to add such stress to its employees to begin with.

    Be even more appalled that it breaches Govt Guidance stated by the Dept for Health in 2013/14. It's hardly news to NHS Trusts that they must NOT run their car parks like this. How dare they?
