OMG three tickets from Highview Parking ref Tesco Car Park
Just_Stoopid
I have received three tickets for overstayed parking in a Tesco car park on the 3rd, 8th and 10th February which I clearly don't want to pay. I live locally and would have more than likely visited on one or more occasion on the same day (sandwiches in the morning/ wine in the evening
)
I have read the newbies thread and Highview parking are a BPA member ... I have also sent an email to the tesco CEO with a massive complaint but not admitting that I was driving or parked there for that length of time!
My question is (whilst I am waiting for a response from Tesco) should I go through the online appeal with Highview Parking and submit the following wording as advised on the newbies thread and when should I do this.......?......
Date
Dear Sirs
Re: PCN No. ....................
I challenge this 'PCN' as keeper of the car.
I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers.
Further, I understand you do not own the car park and you have given me no information about your policy with the landowner or on site businesses, to cancel such a charge. So please supply that policy as required under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
There will be no admissions as to who was driving and no assumptions can be drawn. You must either rely on the POFA 2012 and offer me a POPLA code, or cancel the charge.
Should you obtain the registered keeper's data from the DVLA without reasonable cause (e.g. if you do not fully comply with the BPA Code of Practice in terms of signage at this site, for example) please take this as formal notice that I reserve the right to sue your company and the landowner/principal in your contract, for a sum not less than £250 for any Data Protection Act breach.
For the avoidance of doubt, I do not give you consent to process data from the DVLA relating to this vehicle, whether you have already obtained it or not.
I have kept proof of submission of this appeal and look forward to your reply.
Yours faithfully,

Is that the blue text from the Newbies thread, with nothing added or taken away?
If so, then that is the right text.
You will need to to that each time for each individual PCN.
And yes,do that in parallel with any complaints to the store.0 -
That's great thanks .. should I file all three appeals with the PPC now?0
-
.. and yes it is the original text no omissions or changes!0

if you do add anything , you could add that the driver MAY have made a few short visits and your anpr cameras and computers have failed to distinguish these multiple visits
its called "double dipping" , look it up and read parking pranksters blogs about it too
NEVER reveal who was driving, not even to your nan
appeal each one separately , so 3 tickets = 3 appeals , then 3 popla codes with identical appeals (if not cancelled)0 -
Quick update just had three separate emails cancelling all three tickets .. thanks for all your help guys!0

Easy wasn't it?! Shame everyone doesn't know how to appeal against Highview, although I did always prefer the stance taken by the Parking Prankster against them!

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
