Just wanted to say thanks to the admin(s) & anyone else who contributes to this forum.

I've just had a PCN cancelled by using the standard template, with a couple of additions. Pointed out the notice was received 15 days after the incident (and no-one was admitting who the driver was), and also that it states "car park" where there are actually four separate car parks. Not sure if this will have made any difference as I'm guessing they would fail on GPEOL anyway.

Sportspace themselves won't (at least last time I talked to them) cancel the notice until you've appealed and been rejected.

This is the second one I've had cancelled for the same location (different cars / drivers / circumstances). On that basis, is it worth taking it up with DVLA and the ICO? Clearly the notices won't get past POPLA, let alone a court, so do they really have reasonable cause?

    Nothing fails on 'no GPEOL' these days, that's old news. And the DVLA do not care about minor issues, they will fob you off.

    What grounds were you thinking of for an ICO complaint about data handling/processing? Parking firms are allowed to get the DVLA data late and to send a NTK out after 14 days as long as it does not suggest keeper liability,which CEL ones don't. So they are allowed to use DVLA data to enquire who was driving.

  • GPEOL - sorry, obviously been reading old posts!

    My thinking for a complaint was along the lines of...

    CEL are issuing PCNs which they know in advance are not enforceable, which is evidenced by the ease with which it's possible to have them cancelled. This indicates that the PCNs themselves have little or no legitimacy and are a purely speculative attempt to fool the public into handing over payment. Does a speculative claim then provide reasonable cause to request keeper details from the DVLA? I would say it doesn't, and DVLA should not provide my details to anyone where there is any question at all over the legitimacy of the request.

    Just a thought.

    I think you will get knocked back because any AOS member PPC can get DVLA data just to ask who was driving. And CEL will say these are enforceable against drivers (they do court sometimes and I'm sure they win against the unwary or unprepared).
