Problems with Groupon

Has anyone else had any problems with Groupon? A couple of years ago I bought an iPhone for my son through Groupon. The advert said that it had a 12 month warranty. Outside of the warranty it developed a fault. I contacted Apple who said that it was a known fault and offered to replace the phone. When I gave them the serial number, Apple said that the phone was bought as a bulk-lot for resale purposes on the proviso that they no longer have the Apple warranty. This info wasn't advertised on the Groupon advert.

I'm trying to get Groupon to take responsibility, under the Sale Of Goods Act, but they deny all responsibility, just repeatedly stating that the advert shows it had a 12 month warranty.

I've just written to Citizens Advice to see if there's anything they can help me with. I would go to the OFT but apparently they've disbanded now, and the retail ombudsman state that they've dealt with Groupon before, but were ignored, so won't take on any more cases against them.

    Was it bought directly from groupon or did you effectively buy a voucher from groupon to redeem with another retailer?

    You say outside twelve months but how long ago exactly? How did you pay? How much did you pay?

    As it is more than six months since purchase you may be required to prove that it is an inherent fault and not one caused by wear and tear, misuse, user error or physical damage.

    They don't have to say in the advert that it's not covered by Apple. All it has to come with is a 12 month warranty as they stated, which isn't any help to you now that 12 months has passed.


    So as the poster above has stated you need to prove it was inherintly faulty, which seems unlikely considering it is a "couple of years old". But you best bet would be to ask Apple if the fault is inherent.

    In that case it's not groupon you need to chase it's the retailer that you redeemed the voucher with. You've probably also lost the protection from the credit card too because you used the card to purchase a voucher and then the voucher to purchase the phone so there is no direct link between the card and the phone.

    Then send them, the seller that is, a letter before action, followed by court action if need be.
