  • This is my worry: coming up against a DJ such as this if our excel fight gets to court. Surely the judge was acquainted with the 'rights of audience' statute? Why was he so dismissive of the perfectly adequate defence points?

    Congratulations to BB for the deserved win but - by God - what an uphill struggle.

    DJs, like any other public servant, are accountable for their actions and decisions. A strongly worded letter of complaint to the MoJ is in order here.

    "The judge ruled that PoFA wasn't required to transfer liability as the driver was acting as agent of the principal - and that the law of agency applied. Therefore, as principal the keeper was liable".

    I've seen this a couple of times now - who is feeding this rubbish to the judges as an alternative to PoFa and why are they being allowed to ignore statute and peddle this drivel.

    "The defence submitted a Land Registry Title that showed the Landowner wasn't who the claimant claimed it was nor with whom the claimant had a contract. The Judge was unimpressed stating "I'm happy that a contract was in place for the operator to issue charges. It doesn't matter if it's not with the landowner. It could be that the landowner sold the property to Ashflame S!!!!horpe or that they have a lease or even that that they are trespassing but what is important is that they have contracted VCS to control the area."

    Now I am totally confused ! According to the judge, my neighbour can call in VSC, they can put signs on my driveway and issue tickets to myself for parking on my own land, fully knowing that they are trespassing - and the judge will back them up -unbelievable !

    I realise that this is the 'defendant's reps' (BB) version of events and possibly may have been incorrectly remembered. Although the defendant won the case I would have ordered a court transcript to get an accurate verbatim wording so that a complaint can be made if any discrepancies are proved.

    Judge Bingo!

    At least this case lets us know of the risks of going to court. Most judges are not well versed in arking law, so make silly mistakes like this. Its up to the defendant to put in a strong show.

    I read that blog this morning.

    I minded to wonder whether DJ in this instance means Disc Jockey rather than District Judge, given how much grasp of the law this DJ seems to have! :eek:
