Another Gladstones letter

Back in January 2016 I had loaned my car to a Dutch national who was over here for a few days. He had parked in a car park, purchased a ticket (£5!) to park, but unfortunately did not realise that a certain number of spaces were not included. I travelled over to the car park to look, the instructions were for visitors to park in "blank" bays. There was only one meter, this was situated close to where my friend had parked, visitor parking was at the rear of the building. I did write to UK Car Park Management appealing once I had received the Notice to Keeper, but had received no reply so I wrote again to confirm they had accepted my appeal but received what was claimed to be a copy of their rejection letter. I did write again asking for proof that their rejection letter had been posted in a correct and timely manner, but thus far this has not been received. The "copy" that was sent arrived after the further appeal time had lapsed. I am in the process of drafting a reply to Gladstones and I would be grateful if anyone with greater knowledge of the system could advise if the following would help my case.
Dear Sirs,
Your Ref XXXXXX
Thank you for your letter dated 7th February, received 17th.
As notified previously to your clients, no letter of rejection was received. When I wrote asking them to confirm the matter had been closed, I received what was claimed to be a copy of their letter. I have repeatedly asked your client for proof that any original was posted correctly, but this they seem unwilling or unable to do. As the alleged copy was not received until AFTER the time limit for appeal had passed, I have requested that DRP either instruct UK Car Park Management Ltd to send me evidence their rejection letter was correctly and timely posted, or invite them to cancel their fine.
I trust you will now impress upon your client the urgency of providing the requested evidence, of if this is not possible then to arrange for this fine to be cancelled.
Yours faithfully.
Any advice will be gratefully received.

The talk of visitor spaces points towards this being a residential parking spot, was it?
and was the Dutch Visitor visiting a resident? From the Plain Language Commission:
"The BPA has surely become one of the most socially dangerous organisations in the UK"0 -
It's an office block with several small offices, although it was in the process of having the top few floors converted into flats.0

Did you tell them that the driver lived in Holland?
If not, why not?
Will the Dutchman be prepared to confirm that he was the driver?0 -
Was your friend making use of the car park as a customer or member of staff within one of the offices? If so, have you tried speaking to the company that uses the offices as they might have a direct contact to Gladstones whereby they can get the charge cancelled (and if you explain it was a misunderstanding, they are likely to be helpful).
Guys Dad, are you suggesting that on the grounds that Gladstones are unlikely to chase a debt as far as Amsterdam?0 -

YES !!!
Out of jurisdiction and the cost of pursuing it would be prohibitive.0 -
You need to understand that Gladstones operate and run a joke of scam under the label of the IPC
You can read all about the scam by searching the site
You can also read all about this mickey mouse solicitor here

If the driver lives in Holland then simply name him as the driver
There is sweet f..all that Gladstones can do
If you do this, let your dutch friend know that he/she will get stupid letters from Gladstones and their associates but there is nothing they can do
Gladstones are so stupid that if you gave an address on the moon, they would write there0 -

If they write and confirm they were the driver, so much the better.0 -

Why bother, if Gladstones don't understand, not the keepers problem, let Gladstones play their silly games and waste their own money .... they do this often hence
"you have been Gladstoned"
Let's face it, if the SRA think that Gladstones is fit for purpose then the SRA themselves are NOT fit for purpose and not a place to find a good solicitor0 -
Of course - but you need to do this quickly, before court commences, and give the name and address for service (in Holland) and warn the driver to respond and confirm he was driving but is out of jurisdiction by the English courts and that they must tell their client to cancel the charge because any court claim will be met with an immediate action to contest jurisdiction.fine_to_park wrote: »Guys Dad, are you suggesting that on the grounds that Gladstones are unlikely to chase a debt as far as Amsterdam?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
