Private Parking Company No Longer Monitoring Car Park

Hi all
I received a parking charge notice for overstaying in a car park in Swansea just before Christmas. I have already appealed to the company (Premier Park) with my reasons which they have rejected and I am now at the POPLA appeal stage.

However I returned to the car park today and noticed that the signs have changed and it seems to be monitored by a different company. Also on the signs it has increased the maximum stay length from 3 hours to 4 hours and I had overstayed by just 13 minutes originally.

I was just wondering that if the car park is no longer monitored by the same company would it affect my POPLA appeal and would appreciate any information to include in my appeal.

    You could mention it as part of your introduction and say that by comparison the signs are far more obvious now and clearly the legitimate interests of the landowners was in fact to allow 4 hours which is much more realistic, given the shops there and how busy it gets.

    Then reel off the usual POPLA templates about 'no landowner authority' and 'unclear signage' and lots of info about BPA 'observation period' and 'grace period' and lay it on thick that this was just before Christmas, so explain in detail how the driver was held up in a queue on arrival before finding a parking space, as well as after parking, queuing to leave out onto the main road.

    Since this was in the Christmas rush is is entirely reasonable to take, say, 6 minutes on arrival to find a space then maybe 7 mins after driving out of that space, then waiting in the long queue to leave. If there is a busy main road there and/or a traffic light at the exit, say so.

    HTH, show us your draft first. 'No keeper liability' is debatable because POPLA are deluded about the '29 days' wording in PP's NTKs.

  • Could be worth finding out just when the old ppc finished and the new one started. Maybe the old one overstayed their time.
