    I have to admit I am very surprised that the deeds were not written with a survivorship clause as whenever my DH and I have bought property we were told this was the standard way to buy property in Scotland.

    In this case I could write a will leaving half the house to my children but it would fail as the survivorship clause would mean that the house would not form part of my estate. It would pass to my DH and no amendment of the deeds would be required.

    Has your current solicitor confirmed that no such clause was in place?
