    "Forthwith" does indeed mean immediately.

    Unlike some clown on one of these "Send In The Bailiffs" programmes, who tried to argue that he has 14 days to pay.

    Because that's how long a "forthwith" is. :rotfl:

    How much have you been awarded? Calling in the bailiffs to someone who may have next to no assets is just throwing more money away.
    If the assets are under a limited company (I'm thinking van, power tools etc), and you have judgement against him only as a sole trader, then they won't be seizeable.
    No free lunch, and no free laptop ;)

    According to the legal dictionary: -

    "forthwith. adv. a term found in contracts, court orders, and statutes, meaning as soon as it can be reasonably done. It implies immediacy, with no excuses for delay."

    No mention of 14 days - unless he thought it was like a fortnight!! In which case ROFL.

    Hi all,

    He's a sole trader and the judgement is against him. We don't know what assets he has. There seems to be a way to have his bank balance checked and salary/takings docked, this might be a better way...

    In terms of "forthwith" etc we requested in the request for judgement that the money owed (other side of £4k) be paid immediately. We've heard nothing from him and I assume the small claims court hasn't either, as the claim hasn't been updated on the web portal.

    I know that companies can "sell" their debt to collectors, getting at least some ££ back and washing their hands of it. Anyone know of any firms that do that for individual debt?

    For £4K you can uplift it to an HCEO. Google HCEO and let them chase him. They are much better at recovering money than a baliff.
