Yes, it could be used for that, but I don't think that's the primary consideration for the OP:
"My email basically stated that I wanted the item back and explained to her about my daughter and about the surgery, etc, what the item meant to me. I didn't ask for the money back."
I'd imagine that it would be possible for legal action to be taken for the return of an item, but it would probably have to use a more costly method than small claims.
Indeed £300 + hearing costs - which may be reclaimable0 -
Despite what that item means, I'd have felt stupid going to court over a single toy rabbit. Recuperating the costs of the holiday would have been nice but I can't be bothered with a small claims court or any extra hassle. That was only an option for me if I was able to/had to go the route of bundling up the money and the toy rabbit together in order to get the latter back. Whether or not I had any grounds regarding the money, I'm not sure. I have a payment from her into my account for part of the trip which shows it wasn't intended as a gift. I ended up paying for the extra flights etc at the time because she "had the wrong card", I don't even know if that was true.
I've not heard anything back yet. COB on the 21st was the deadline for agreeing/not agreeing to the plan. Since I've not heard anything, I'm assuming she hasn't accepted it and is going ahead with the grievance.
In terms of the bleed and my emotions being labile...I've not wanted to use it as an excuse for anything. I was worried that people might treat me differently when I returned to work because of it. I feel like it'd be hypocritical to start using it as an excuse or reason now.0
