Hi all,
I am new here, and came across this site on google. My niece has today received a parking Charge Notice from Smart Parking, for Strothers Lane in Inverness, for the 12th February 2017. It was after 6pm, and she was not the driver. She is reluctant to pay this, as she wasn't the driver. Any help here would be appreciated.

3. Don't contact Smart
4. Do a search here for 'Strothers Lane' - many cases have gone before you.
5. Do a search on 'Scotland' - advice is consistent throughout

Your niece will not be paying anything.
It's SCOTLAND and Smart know there is little they can do, but they do try it on.
To do anything in Scotland they need to know who the driver was and NOBODY is going to tell them
So, ignore Smart
You will probably get numerous silly debt collector letters making lots of wild threats ... BUT THEY ARE POWERLESS AND TALK RUBBISH
IGNORE THOSE AS WELL.
Never be tempted to converse with these scammers, just let them waste their time0 -

Thanks guys, I have told her not to have any contact with anyone from Smart Parking or anyone speaking on their behalf. As long as she doesn't say who was driving they can do nothing, is that right?0

Theoretically, they could take court action as anyone has the right to do. But as long as she can say and, even better, prove she wan't driving, they can't win. In England, they can fall back on keeper liability.
However, in the IGNORE advice, if a solicitor's claim letter hits her welcome mat or court papers arive, then hotfoot back here. Also, keep all correspondence filed.
You can consider a simple letter to the PPC saying
"Dear PPC,
I refer you to ...............
I was not the driver on the day in question, have proof of such, so I will not be paying this charge. I suggest you pursue the driver"
That would help should it ever get to court as it shows the "not driver" story wasn't made up on the day of the court.0 -
My niece was on a coach at the time they claim her car was in strothers lane. Witnesses would be good, could she use cctv footage to benefit her.? Thanks guys0

in the Scottish version of the county court , when talking about "parking offences" , it would be upto smart to prove the defendant was driving , not your job at this point to spend time and money disproving it0
