Thank you both for your advice. I have edited the post and also looked at the thread mentioned which gives some interesting comments on the company involved although in parts the depth of legal points was over my head!!

that is the trouble with contracts , they are subject to legal clauses and words that go wayyyy above most peoples heads (including mine) , its never simple
why do I say this ?
because parking a car usually involves entering into some form of contract , which is what happened in this case , avoidance is always better than repair (like accidents)0
