BW legal PCN from 2011

Hello,

New to this forum so please forgive me in advance if this is not the right approach.

I've received a BW Legal PCN with a date of contravention 25/03/2011, nearly 6 years ago!

This is the first I've heard of this fine, for an apparent parking without displaying a valid ticket. The fine is from Excel parking but been passed to their legal service provider, BW legal.

I'd just like some advise on where we stand with this, is it worth appealing?

    You will not be appealing but you need to respond with some questions, to string it out to the 6 year limit, after which BW Legal can't lawfully file a claim. They are trying it on and you just need to keep replying with questions, as the registered keeper at the time.

    DO NOT GIVE AWAY WHO MIGHT HAVE BEEN DRIVING THAT CAR. THAT IS THE PIECE OF THE JIGSAW THEY WANT AND DO NOT HAVE.

    Just ask for further information within 21 days, e.g.:

    - a copy of the sign/details of the location
    - evidence of a PCN on the windscreen and/or a copy of that PCN
    - or evidence of a postal PCN and a copy of that PCN
    - evidence of the party they are holding liable because a keeper can't possibly guess and they can't hold a keeper liable back in 2011 (in fact Excel never could).

    Tell them you know nothing about this alleged incident and believe this letter is vexatious and unreasonable after so many years, indeed it bears all the hallmarks of a scam. As such, you do not consent to your data being processed at all and wish to know when and how it was obtained, if from the DVLA, on what date did their client get this data? Tell them to cease processing it NOW and to consider the letter a Section 10 notice under the Data Protection Act.

    Give them 21 days to confirm they and their clients have deleted your data.

    Another Excel try on with their worthless so called legal team

    As coupon-mad correctly said, back in 2011, the piece of the jigsaw they require is THE DRIVER.
    They don't have that so they have a BIG BLACK HOLE.

    This is now why Excel and BWLegal are losing in court

    Play letter tennis with them and be prepared to receive even more rubbish from them.

    A quick complaint to the CSA would be an insurance policy. I believe they have to answer the complaint before they can proceed further under the CSA rules and as this process takes several months it will easily carry you over the 6 year limit.
