I've been trying to search for Parkingeye POPLA but i cant quite find anything useful.
I've literally spent the whole morning looking at this forum.
there are literally thousands of threads about PE and popla appeals on here
the NEWBIES sticky thread has a whole section dedicated to popla appeals , with copy and paste templates you can adapt , so unless your copy/paste is recent it wont wash (and most people here wont proof read it for you either due to the sheer number of words)
if catfunt above thinks you havent studied it in detail and compared it to recent popla appeals plus your "circumstances" , then he must think its not the right fit for you
I suggest you check that newbies sticky thread and compare what CM has written recently, to yours above , then to compare it to "what happened on the day too"
especially as an "overstay" (like the BARRY BEAVIS case) is not the same as a "double dip" case , your first post suggests an "overstay" by the driver, yet the copy/paste appeal refers to "double dipping" on the M4 and some services there0 -
lol , I will edit it , must have had 2 tabs open at the same time

thinking more about the content and not the person , because the content is important
I do agree with you that the popla appeal draft does not bear any resemblance to the information provided earlier , not a motorway , not a double dip , is similar to the BEAVIS case which was an overstay etc0 -
Was this a "double dip"?You never know how far you can go until you go too far.0

Thanks for the constructive feedback, i'll go away and do more research.
and no, it wasnt a double dip. but would they spend time and resource to prove it?
Can i also add i struggle to find valid points to fight the case with the pointers on the post on the newbie thread as I find the pointers i.e. signage, no driver liability irrelevant to my case. any pointers would really help.
Thanks.0 -
PE took BARRY BEAVIS to 3 courts , county court , he took them to the court of appeal, then it went to the SUPREME COURT , with the judgment about 15 months ago
PE issue over 25 THOUSAND court claims per annum
and you think they wont bother checking this one ?
even though they got a judgment at the S.C. for an overstay by BB ?
on the overstay similar to your vehicle ?
with ANPR cameras clocking the overstay (like BEAVIS)
mmmmmmmmmmmmm
no , they will just rollover and play dead

Nothing in the OP's first post to suggest that it was.
To any newbies reading this thread - this highlights why you need to read the newbies thread - and digest and understand the contents and issues.
It only took a very brief skim-read of the appeal pasted above to see it had not been read properly...
If you do cut and paste from another appeal, then you need to read it thoroughly and make sure it is 100% accurate for your case.0 -

We may be anti-PPC on here, but no-one will condone lying.
When it goes to POPLA, you raise all the relevant points of law, with regard to sign-age, having proper contracted landowners right to issue tickets, keeper liability etc.etc. They are ALL relevant - It is all in the Newbies thread.
PE sometimes give up if they get a very lenghty appeal from POPLA, and not contest the appeal, so you raise all points, and make them work to refute them all.
Have you outed yourself as the driver in your initial appeal? If not, change your post now.. no reference to "I", but "The driver".0 -
First question with any PE PCN, was it one that talks about '29 days' until keeper liability, which arrived within 14 days, or is it one with none of that and a 'blank space' (missing words) at the bottom? Like the one linked in post #3 of the NEWBIES thread, the blank space version or not?
If you don't include 'signage' and 'no landowner authority' you will be shooting yourself in the foot. And if it's a blank space (late posted) PCN you must have 'no keeper liability'. Unfortunately most PE PCNs are not like that but check, some are!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
