  • I'm in the process of finishing everything off deliver to the court tomorrow (and send to the rep).

    I've got a skeleton argument, evidence (such as POFA 2012, Henry Greenslade, the PCN, insurance docs and relevant cases including Lamilad's). I was also going to do an evidence statement which highlights the bits of evidence I will use and points out why they support my defence.

    Is this correct, or do I merely provide the evidence and highlight which points I will use and then save my arguments for the hearing?

    I've also looked at some witness statements. Is is essential that I include one of these with my skeleton argument or will the skeleton and the various evidence I've got be sufficient?

    A skeleton argument is not a requirement but is a good idea. Whatever is in a skeleton argument can be your oral argument on the day. Depending on your presenting skills you may wish to keep things until the day or present the bulk of your stuff in advance. Horses for courses, as they say.

    The WS is essential, with the evidence you intend to rely upon. You must file a WS to the court and claimant's solicitors.

    A skeleton is not required, but as Henrik777 says, it is a good idea to help you summarise the legal points.

  • Ok thanks CM. I'm just trying to sort now. I've been pulling stuff together for what seems like ages and am using something similar to what H_brogab used.

    I had an original skeleton which mentions POFA - from that do I then point to the POFA, Henry Greenslade etc?

    Yes, strictly speaking that sort of thing goes into your skeleton argument bullet points.

    The WS should be the facts as you can confirm them (what the driver did, whether signs were visible, any other facts from the day also facts about letters exchanged since, appeals made, etc). Not the legal arguments about keeper liability.
