    Children's lungs are very vulnerable to damage from air pollution like this.

    You could apply to court for an injuncion, but this would be slow and stressful. I imagine you'd need plenty of evidence eg

    * neigbour witness statements
    * logs going back months recording dates, times and durations and extent of nuisance on each occassion
    * video recordings
    * most importantly, reports from EH

    As for the previous owners, assuming you have evidence of the conflict prior to their sale, I imagine you could sue for your losses. Quite how you evaluate those losses I'm not sure, nor how likely you'd be tosucceed - an experienced solicitor could advise (not a conveyancing warehouse if you used one).


    Neighbour will probably burn the logs.

    Sorry I misread your original message. I didn't realise that they are actually burning the poop ewwww that must stink their house out.
    If the smoke is thick black smoke I wouldn't let them out in it either.

    I would try and video the garden being covered in the thick black smoke for evidence.

    Thanks, we have lots of videos and pictures ready. The sad thing is both the neighbour and son who lives there have lung issues they happily volunteer this information to us, I know it could be unrelated but I feel like shaking them and saying don't you think you might not be helping your issues!! I think it is a hobby collecting old furniture and burning it as every day they come back with a car load and there's always a nice pile on their drive... !!

    mojilosa - this is what worries me as I have had a baby while living in this house and I have been very upset and worried about his newborn lungs I have spent a lot of time out and about as I've not wanted to be at home while he has doing it - which is easier said that done with an 18 month old and a new baby!

    Suggest whatever complaint you make is factual, rather than rambling exaggeration - is it "continuously", "nearly every day" "multiple times" or what? And cat !!!!!!?!? How can you tell? And how do you know it's cat rather than dog...?

    Finally, if it's really that bad, surely you would have noticed when you viewed the place...?

    Have you got your local councillor involved - ask if he/she will come round when next door are burning stuff so they can experience the nuisance for themselves?

    How many other houses are affected? If you can group together, your voice against the pollution will be stronger.

    I would be particularly concerned that the neighbours are burning plastic - the dioxins released when these are burned are particularly dangerous.
