Housing benefit and a second property. please help?

    What is your income?

    If you are receiving a means tested benefit e.g Income Support then hopefully the DWP will have assessed the property already and if so disregarded it or taken it into account for your award, the HB section will then have to ingore it until they say so

    I've gone self employed and I have set an online business up so at the moment I am in receipt of child tax and working tax (I'm presuming that's means tested) . I'm just hoping my benefits won't be affected until I can get a quick sale :)
  • Move back in and get a restraining order on the father? Don't let him chase you out of your home!

    As you are self employed unfortunately HB will want to value the property

    I doubt they can disregard it as there is a sitting tenant - but ask them if you are definitely putting it up for sale

    They will require proof of tenancy, outstanding motgage, estate agent details etc.

    Also try to obtain evidence of the payments your dad has made and evidence he wants it back - it's not a gift - as they could say he just helps out (but the HB section determine this or not)

    Thanks for your response

    As I have a 32k mortgage and a debt of approx 10k with my father he has offered to buy the property off me for 48k. I was hoping to get more however he said he will pay all solicitor and legal fees. Then this would enable me to walk away stress free. I really don't think I have any option I could hold out for 55k but for the sake of a few thousand pounds I will just be glad to see the back of it. I can't see my circumstances changing for the next 12 months. I'm just hoping housing will be ok with this?

    Depends on the actual value. If you are seen to be selling cheaply to your dad to end up with only 6k (that figure keeps popping up...) it may raise questions.

    I've done some research and there have been 4 properties that have sold nearby this year ranging from 50k-55k. I agreed 48k with my dad as this covers the 32k mortgage approx 1k costs and his 10k plus interest. I won't get anything from the property however I will have a huge headache removed. I could try and hold out for another sale but then may take another 6-12 months which could cost 5k in mortgage payments which I can't afford. I'm just hoping this will be acceptable to the benefits?
