Advice needed. Damage to vehicle.

Hi all.
I'm hoping someone can help me.
I am a self employed parcel delivery driver.
On leaving a customers property my van was damaged by the gate when the wind blew it into my path.
When I entered the property the gates were wide open. I did not open them myself. The gates were not secured and after checking nothing in place to secure them. I understand this is an accident but my van is damaged. Maybe around £500.00 to repair. The gates catch was damaged also in the incident. Now the customer wants to claim against me!
Do I claim against the property owners household insurance?
Any help is greatly appreciated.

    You might want to post in an appropriate forum like Motoring or Insurance - Discussion time isn't really the place to be asking.
  • It's possible that the owner will claim that you drove into the gates which caused them, and your van, to get damaged. Can you prove that the gates were not properly fastened? Even then it may all go down as an act of god.

    However pogofish is correct. Try one of the other boards for better advice - this part of MSE is not renowned for accurate or honest postings :)

    As a self-employed person you are responsible for your own health and safety while working and - I assume - you have business use insurance on your vehicle?

    If so, call up your insurance company and ask them for advice - it's why you pay for insurance in the first place.

    If not, doubt you'd get far in a civil claim if it came to light you were driving without appropriate insurance - what's that? 6 points?
    That sounds like a classic case of premature extrapolation.

    If it's gouged a panel so much that it can't be pulled out or filled than the whole panel needs replacing. Soon adds up.
  • Householder failed in their duty of care, unless there were were warning signs about the gate

    Go to your GP, you may have got whiplash too.
