Yep, that's pretty much how I read it. We know we haven't got a leg to stand on but hey we are prepared to go to court anyway!. They wont, they are bluffing, no legal department in their right mind would start proceedings for something they already admit they don't have a case for. Personally I'd send them a letter saying see you in court... that is, the court in my town, thats really easy for me to get to, oh and I wont need expensive legal representatives, I'll just show the judge the letter with this paragraph highlighted
we are also aware that the courts would not grant an enforcement order should a default summons be issued because of non payment and it was defended on a challenge to produce a copy of the original signed agreement that we could not produce..
but then again I'd find it really interesting to see how they tried to defend against something they've already told you they know they cant.

whats the background to this debt this will help with advice as how to proceed, do you acknowldge you owe the debt and you want to pay it back but you are having difficulties or has it turned up out of the blue?0 -

In that case have you concidered speaking to the likes of CCCS, CAB or national debt helpline to help you with a DMP for all your debts?0

In that case I think its wise that you just deal with National Debtline and pay what you can in the meantime to your creditors. With their support I'm sure you will be feeling better in no time at all.0

Surely these charges are punitive? Sounds like the "Studio card" is one to avoid at all costs0

kevicho - studio is certainly one to avoid - their prices are cheap but charges steep - they sent me a breakup of my account and im surprised by all the charges....but - what do you mean by punitive? does that mean they are illegal or something? (sorry for being a bit dim lol)

Basically it means they are penalizing you for late paymentsI am a debt counsellor working in the voluntary sector - we don't charge our clients for the work we do!0
