Online retailer - refund or exchange on sale item query

Hi all,

A very quick question from me. I've tried to find the answer online but can't.

I recently bought an item of clothing from an online retailer. It didn't fit so I submitted a returns form (within the allocated timeframe) and returned the item.
However, the retailer has emailed me to say that because the item was on sale, I am not entitled to a refund, only an exchange or a credit note.

Is this correct? How does this sit with the Consumer Contracts Regulations 2013?

Any help/information gratefully received.

They are not correct, you are quite entitled to return it for a full refund.

Assuming you have complied with the CCRs, eg, returned the item within 14 days, then they are quite simply wrong and confusing online purchases with instore purchases. Reply to their email and tell them you are entitled to a full refund under the terms of the CCRs, the fact that it's a sales item is irrelevant.
