Excel lose Peel Centre case.Motorist not responsible for faulty payment machines

The hearing
The claim was dismissed.
The judge ruled that it was up to Excel to prove that the machines were in correct working order, and that Ms P's word stacked up with the evidence (a partial registration recorded in the machine log)
Excel are having a great time recently :rotfl:
As the judge laid into the BW Legal stooge Ms P actually felt a bit sorry for the solicitor at some points!

Sent s.o. to collect a battery. In car in Costa car park having a coffee whilst battery shop opened. None of shops on Peel Centre open. next thing a ticket in post £60. i had to ring, email x10 a day to get a response! Paid too late so now £100. if it was late it wasn't my much! I had to prove i gotta WorldPay email confirmation.
i gotta email saying £50 by mid Feb &
another £50 by end of Feb.
Thats £160 for sitting in the car having a coffee. i haven't paid anything extra apart from original £60.i work for a Council & they can't help or advise.
i think this is a scam. Any advice?0 -
yep, next time you get one read the NEWBIES sticky thread on here, dont just pay sc@mmers , now they have their hooks into you they have 6 years to make you pay or take you to court , where you can plead your case in front of a judge
that car park is a sc@mmers paradise unless you get a paid for ticket AND input the correct registration, assuming those !!!!py machines are working correctly (which they often arent)
the onsite staff who look after that car park can cancel tickets with valid reasons , parking prankster listed their emails etc not long ago on his blogsite, so maybe contact them
otherwise, once you are hooked there is nothing you can do except pay or fight , nop other options exists and you are now between a rock and a hard place0 -

Yes, why did you pay £60 for this racket instead of Googling it first? As Redx says, they now have you on a suckers list.
No-one rings Excel and no-one pays Excel here. They will now bother you a lot. They might try a small claim to scare you. If so, start a new thread and DO NOT throw good money after bad.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
