PCN- APCOA Luton Airport

Hi,

First off I hope I’m not repeating previous posts re. above.
I recently received a registered keeper PCN for dropping off outside designated area at Luton airport.
I replyed by email, using “newbies template” and asking for POPLA code . I then received a reminder letter, which I replied to pointing out that I had sent the original email. I included a copy. I've now had their reply (email) which basically says,

Luton Airport is a private property of London Luton Airport all the enforcement are carried out according to British parking association (BPA) guidelines and APCOA being an approved operator of BPA is authorized to manage and enforce the property on behalf of London Luton Airport. Any vehicles in contravention of the T&C of the Luton Airport are sent out to DVLA for registered owner’s information under BPA guidelines.
Notices on private land are issued in accordance to British Parking Association (BPA) guidelines and APCOA being an approved operator of BPA is authorised to issue notices on behalf of Birmingham International Airport.
Proof of this landowner authority is provided below:


But they have included a copy letter for Birmingham Airport not Luton! They go on to say;

“For the avoidance of double you should note any offer included in your letter other than to make payment in full of the Parking charge notice is hereby rejected.

As your vehicle was parked in contravention of the terms and conditions of the car park we are satisfied that the notice was correctly issued in accordance with the BPA code of practice, and are therefore not able to waiver the charge on this occasion.

Taking into account the details mentioned in your letter, we are willing to reoffer you the discounted rate of £48.00 as a gesture of goodwill. If payment is not made within 14 days of the date of this letter, if payment is made after 14 days the charge will increase to the full rate of £80.00 and continue to progress. “

You have now reached the end of our internal appeals procedure, to make an appeal to POPLA – The Independent Appeals Service, within 28 days of this letter by completing the online appeal form at quoting the verification reference number . Please be advised that if you opt for independent arbitration of your case, the Parking Charge Notice will be considered at the full amount of
£80.00 If you require a hard copy of the POPLA form please contact our customer service centre on 0345 301 1151 where one of our customer services agents will be happy to assist you.
By law we are also required to inform you that Ombudsman Services provides an alternative dispute resolution service that would be competent to deal with your appeal. However, we have not chosen to participate in their alternative dispute resolution service. As such should you wish to appeal then you must do so to POPLA, as explained above.’


So the main points are:

1. They have issued a reminder with incorrect issue date of the original PCN
2. They have included a letter of authority for the wrong airport
3. They’re saying that I’ve reached the end of they’re internal appeals procedure.
4. Gesture of goodwill they reoffer the discounted rate £48 if payment made within 14days.
5. I’m not to reply to the email.


I'm wondering if the lack of code and the need to contact POPLA direct is a recent change in procedure?
I welcome your thoughts/advice

    Errrrm...yes they have...

    Remove the POPLA verification code from your post right now, it is for you to use, no-one else! :eek:

  • Please bear with me as like many "newbies" I'm confused as to what to write and totally reliant on the seasoned members of this board. I was going to copy Kiity25 (Oct.16), omitting points 4 & 9?
    But I wonder if I should make more of the bylaw point and use the "No Evidence of Landowner Authority template on it's own?

    2. POPLA and appeal process for Railway Land
    There is a meeting on 27th January 2017 to discuss this issues. John Gallagher decided to
    make a decision on the outstanding cases as they could not stay adjourned, he concluded
    that he would allow them all. He has invited the Operators to withdraw them and will allow
    the rest. He is meeting with with the DVLA, DCLG and the Railway Operators on the 27
    January 2017 to agree the process including the appeals.
    If you park in a railway car park it will be a criminal case and they will allow clamping, which
    does not seem good practice.
    One possibility is the DVLA to say that operators can continue to use POPLA but this means all
    appeals will be dismissed. Currently they are bound by the decision where the appellant is
    not. The alternative will be to take POPLA out of the equation and then it is pursued through
    the criminal system


    APCOA will pull out of POPLa before they do it , saving £27

    the above is fore railways , but hay - hoo whats the difference

    best use this 2017 recent appeal and adapt it , also pointing out the errors like the landowner authority for BHX and not LUTON (apcoa are imcompetent) , plus anything else

    Thanks for your post. The posts from your link only refer to appeals to APOCA only. Are you saying to I should use this but adapt it for my POPLA appeal?
