myparkingcharge.co.uk & NTK

So on 18th of Jan a "parking ticket" from myparkingcharge.co.uk was placed on my car at a local train station car park. At first I dismissed it as a scam as the ticket was the dodgiest looking thing I've seen, "log in t our website to see your parking charge".

Anyway I received am NTK from VCS on the 8th of Feb (21 days after PCN) that was dated on the 31st of Jan (13 days after PCN) asking for me to pay the £100 fine, or £60 if I pay before 14th Feb.

Am I right in thinking that they have jumped the gun and have not waited long enough to get my details from the DVLA?

Do I have to pay this fine, and how do they justify a £100 fine in a free park & ride car park (I've caught the train to work every day for 2 years so they've all ready had a hefty amount of money out of me in rail fare).

What course of action should I be taking now?

  • As an update, I have just submitted a complaint to David Dunford at the DVLA along the lines of what "Coupon-Mad" posted in the above thread (pg 2 post #33).

    I will keep you posted if I get a reply. However I feel that I will end up having to pay the fine.

    Why on earth do you think that, and it's not a fine if issued by a private parking company?

    It is not a fine.

    If the scammers have failed to meet the requirements of the POFA 2012, then why in hell would you think you need to pay this?

    The NEWBIES thread tells you how to appeal these scam tickets.

    Yep, NTK is too soon so you are right to complain to the DVLA.

    Also, they are using a prohibited premium rate 'phone number for the payment line.

    Have you not read all the threads showing no-one posting here has lost a well-defended case v VCS?

    The DVLA will fob you off, they've done the same to others but that's not a reason not to complain. You will be defending this in small claims and we'd be astonished if you managed to lose. Anyway that's for later this year.

    For now, follow the NEWBIES FAQS thread advice & send one challenge and DO NOT engage with the IAS.

    If you fold and pay like some pathetic victim after coming here, you are sponsoring the firm and funding the next PCNs against vulnerable people. Your are on MSE on a forum with a wealth of info and 100% record in defences v BW Legal so far - so don't join the nasty ex clamper firm and DO NOT support them with money 'for an easy life'. We find that shameful.

  • I've just received this response from David Dunford at the DVLA

    "Thank you for providing copies of these notices.

    DVLA is aware of this practice and has been advised that these ‘cards’ should not be referred to as a “notice to driver”. Where a notice to driver has not been affixed to the vehicle, the parking company may apply for vehicle keeper data from DVLA to allow a notice to be issued by the post. This would be the Notice to Keeper you have received.

    There is no requirement that a notice must be affixed to a vehicle at the time and therefore Vehicle Control Services Ltd do not appear to have been non compliant with POFA or the KADOE contract.

    DVLA has raised some queries with this process with the International Parking Community (IPC) and is currently in discussion on this.

    If you have any concerns regarding the correspondence you have received, I would suggest contacting the (IPC) to explain these.

    I regret that I can offer no further information at this time."

    Where do I go from here?

    Did you not read my reply that already told you the DVLA would say that? Just above yours. So what, really, as expected.

    Never ceases to amaze me when we post saying something, a newbie doesn't read it then says 'what's the next step?' Sorry, a bugbear of mine sometimes, a 'why did I bother to tell you just an hour ago, that the DVLA would fob you off' moment...

    I also told you where this will go next and what to do/what not to do.
