Help! No conservatory planning/building permission & cannot get indemnity

    To be honest I don’t really care anymore that I contacted the council, even if I got an indemnity policy, I still would have had to deal with the issue once we moved in/went on to sell. This way at least I can get the vendor to sort out the problem.

    Waiting to hear what my solicitor comes back with!

    Whilst you might not care, your mortgage lender most likely does care - the issue isn't the workmanship/standard of conservatory, the issue is enforcement action from the local authority (which is unlikely, but lenders usually insist on some paperwork/insurance policy to cover any potential risks)
    Get a builder or a surveyor to assess the conservatory, planning permission or building regs approval don't matter at all for the issues you have with the property, it's just that you've made it harder for a lender to lend on it. It's really a non issue for everyone, except the people putting the money up for it.

    If knocking it down and replacing is your intention what does it really matter? Unless of course your lender is the one that is causing issues by threatening to withdraw funding if the relevant paperwork (which may not have been required anyway by the sound of it ;)) cannot be provided......

    Riggyman as must Swansea Building Control who last month came out and issued a building reg Cert for the conservatory.

    Riggyman - my apologies you are absolutely right and I was wrong on this.

    I have just checked and the original application and planning cert stated side extension and conservatory, but I did not have a bldg. reg cert because I had not submitted the elec cert I thought my architect had done it, so when the buyers solicitor asked for it I couldn't find it so had to get the council out. I got confused with the original paperwork and on checking the council issued a copy and then they had to redo it removing the reference to conservatory in the title which had been just copied over from the application.

    Having had 3 failed attempts to buy a property and now having to move into a rented house because in each case the sellers pulled out for various personal reasons but not price and in the fourth attempt now I am afraid the last few months has got rather confusing.

    So sorry for my confusing response to this post.
