multiple MCOL from ES Parking Enforcement Ltd

I have recently had 4 MCOLs issued against me for separate dates on one car park by the same company (ES Parking Enforcement Ltd) I have filed my defence for each of them, and I have been given a court date for the first. To avoid multiple trips to court I was wondering whether anyone knows if all 4 cases and be addressed in one hearing and if I can forward any evidence, prior to the hearing as in my mind if the evidence were presented to them it would be clear I have no liability whatsoever.


2 of the PCN's were issued when the ticket was displayed (copies retained) and sent to ESPEL with no response. all evidence of correspondence retained.


1 PCN was not issued on the day and a photo without a legible expiry date was sent in the post, I was therefore unable to retain my copy of the ticket


The final PCN was issued on a date after the ownership of the car park had been taken on by the local council and ticket machines removed. I have email confirmation from the local council confirming the ownership had been assumed by the council 9 days prior to the PCN being issued by ESPEL.


In summary I would like to know:


1) can all of the PCNs be addressed in one hearing
2) Where do I send my evidence for review prior to the hearing, (I feel it is strong enough for the case to be thrown out)
3) From my brief description of the events does it sound as though my cases are strong enough.


Any help or guidance would be much appreciated

    Send a letter to your local court with all 4 claim numbers on and ask for Special Directions to 'stay' the other claims and treat this one as the test case.

    In a second paragraph, ask alternatively for the presiding Judge to review the claims and strike them all out at the court's own volition and/or require the Claimant to at least state their clear 'particulars of claim' for all four, since the particulars provided are lacking in coherent facts capable of creating a claim in law. This want of any facts and cause of action leaves you at an extreme disadvantage, not to mention wasting your time and the court's time x 4 times for what is essentially one issue. Tell the Judge how difficult attending four hearing will be for you (work, family, etc).
    2) Where do I send my evidence for review prior to the hearing, (I feel it is strong enough for the case to be thrown out)
    You will have been given a date in the Notice of Allocation and court hearing, it says in the small print the date by which you must file your evidence & witness statement to the court and the claimant's solicitor (Gladstones I assume). It's never less than 14 days prior to the hearing but sometimes is sooner, so read the court letter.

    Also read the info we have in the NEWBIES thread, under the heading 'Small Claim?' as that tells you what to do by when & how to do it.

    Yes if you filed a decent defence - what did your defence say?
