Parking Eye Overseas Visitor

Hi.
In November 2016 I received a parking notice from Parking Eye relating to an overstay in a car park on a retail park. I had lent my car to a guest from overseas that was visiting me. I have provided Parking Eye with the drivers correct name and address and they have now sent the charge to the driver. Can they enforce the fine on a Non UK citizen and are they likely to contirne with legal action if the fine is not paid.

    there is no "fine" (you made that slang word up yourself) , so no they cannot enforce that which is not possible

    they can "invoice" this person which they have done , but as this person is not in the UK then the UK court has no jurisdiction and so any MCOL will also fail

    only they (PE) can tell you if legal action would commence , nobody here can tell you and they would be lying if they did say that they know that answer

    but it is UNLIKELY , especially due to any costs in actioning the case in a foreign court with different rules , different laws etc

    The driver does need to respond (once) to protect you - e.g. how about that person telling PE that they are clearly out of jurisdiction from the English courts so their letters are a waste of postage, since any court claim will result in an immediate move to strike it out.

    They can email and must put the PCN number in the subject line:

    They need to respond once because PE will otherwise make the wrong assumption you named a driver who doesn't exist and will bother you again. The driver must be told not to worry about the threatograms but if PE are daft enough to file a claim and post it to them, then they do need to be ready to contest jurisdiction to quash it.

    When your friends come visiting from Scotland or Northern Ireland get them to do the driving
