UKPC ticket - not sure how to proceed

Hi,

To give you a bit of background, I visited Aldi yesterday to do my usual weekly family shop and took my 1 year old son with me as my wife is suffering from morning sickness, so wasn't well enough to look after him. This turned out to be my downfall!

The car park at this store operated by UKPC, provides you with an hours free parking. Usually this is enough time to do the shop but my son wasn't having any of it and caused it to take longer than usual. Because of this I was 15 minutes over the free hour and ended up with a £90 fine. I realise I did go over the free hour but I feel that £90 is very excessive for what I did. I had only just got my son in the trolley and couldn't leave the shop to buy a ticket as it would be a struggle to get him back in, so thought I'd try to get the shopping done quickly.

I don't have an issue paying for the hour that I partly used (I think £2.50) but £90 is extortionate.

I spoke to the manager but he just shrugged it off saying 'it's clearly signed' and have contact Aldi on Facebook but they responded with ' Regrettably, as we did not instruct UKPC to manage this car park, we are unable to directly assist with your appeal'.

Obviously I don't want to pay this, but I'm not too sure what I would be appealing against? I think £90 is too much for £2.50 missed earnings, is that enough? There are clear signs, and the car park isn't a free one so can't say that they haven't lost out on anything. Do I still have grounds to appeal?

Thanks
Alex

yes you have grounds to appeal , but the not a gpeol argument died 16 months ago with the BARRY BEAVIS case (google it , and read parking pranksters blogs)

the SUPREME COURT do not agree with you , so that argument wont wash

its the landholder or MA you need to contact for a cancellation, so if the supermarket say its not them , then you should have asked who owns the land , or manages it

as for the 15 minutes , its within the "grace period times , (before plus after) so that is one appeal point , plus no contract , poor signage , any CoP failures , any POFA2012 failures , any NTK errors or failures etc

this is all explained in the thread for NEWBIES like you , "stuck" near the top of this very forum

please read it , then please follow it

do not admit to who was driving and edit your first post to remove any reference other than what "the driver" may have done

in future , its "the driver" , not me , not myself , not I

Complain to the overall Managing Agents of the site, this week. Google the place to find them.

And appeal as per the NEWBIES thread as well.

What's the easiest way to find the MA? I've tried googling for it (Parkhouse Court, Hatfield) but I only seem to find commercial listings for properties there. I've also tried asking Aldi on Facebook but they wouldn't give me the information.

Also, just want to confirm that I email the first appeal 25 days after the windscreen ticket? And should I just send the template as-is and not include any specific details (why the driver was delayed by 15 minutes, grace period etc)?

    Thanks

It is not a fine. (You mentioned it in your first post, but that word won't be mentioned anywhere on any paperwork you get from the scammers.)

I cant answer the first question if Aldi won't tell you themselves.

Yes to your second question. This is exactly what the NEWBIES tells you to do and why. Use the BPA template in blue you will find there.

I normally read the commercial adverts and ring or email the agent named - they'll soon tell you if they don't also manage the site.
