help with UK parking control refusal of appeal disabled badge not visible

disabled badge had slipped off windscreen (very windy) in Glasgow retail park and was not clearly visible in photos. Spoke to attendants when we returned to car in disabled bay, who told us, as we had the badge and could photocopy it, we would win on appeal. Have not won the appeal (on grounds that we did all that could be reasonably expected to comply with their rules - outwith our control if the wind from the vents blew badge onto the seat - it looks like a badge may be slightly visible in one of the photos, but not very clear). They want the reduced rate of £50 paid. Have not kept a note of whether I admitted to being the driver, as well as the owner of the vehicle. Was travelling with a close family member with disabled badge. Is it ok just to ignore it from now on? have had a look through the threads, but cannot find a similar case. thanks

    the answer is a definite , YES ignore had the driver not been identified , as there is no POFA2012 in Scotland

    in all these parking charge invoices , you only have to pay if a judge says so, in which case they have 5 years to try a court claim against the driver

    the EA2010 is what you are covered by , so complain to the landholder and get it cancelled

    personally , I would put the case before a judge , cost them money if they did , then let a judge decide , plus issue a counter claim under the EA2010 at the same time

    I would suggest you wait for other replies about this "unique" situation, especially if you feel that they know the drivers details

    Such a shame you didn't come here first you would have known to ignore in Scotland.

    But in all my years of owning many cars I have never experienced a gust of wind inside one with all the doors and windows closed!

    But never the less follow what Redx states above.
  • thanks for the quick replies. yes, I know it sounds weird, but I stuck it in the air vent, as there was a lot of clutter near the windscreen! not very clever on a really windy day, as I think there must be a slight airflow through these vents! I will look up what these POFA 2012 and EA2010 things are and complain to the shopping centre as well. Thanks

    If you are being harassed as above complain to the landowner, send evidence of the disability ( ie a scan/copy of the blue badge or doctors note/prescription copy's etc) and tell them that you expect their agents to stop harrasing you over this matter or you will consider pursing them for discrimination and harassment of a disabled person as they are responsible for the actions of their agents
    The PPC should have dropped this as soon as it became known to them that someone in the vehicle had a disability
