Solicitors terms and conditions Q?

Using Fussel Wright from Bristol.

Just reading through terms and conditions and was slightly confused by this and cant call as its the weekend.
Does this mean if it falls through they will charge me £200 p.h. for any work after done or is it if i take them then swap to someone else? Cheers.

"Term 10. If this firm does not complete the work, we will charge you £200.00 per hour for each hour of work for Partners time and lower rates for other fee earners. We will charge you for writing letters, and for making or receiving phone calls at 1/10th an hour. Our charges for considering letters received will be in units of 1/20th of and hour. Our bill will also include VAT and expenses. Since the transaction will have been abortive we usually, at our discretion, bill at a discount to the full time spent."

    I'd hazzard and say that if it aborts, then you pay for the work undertaken up to that point on a work done charged basis. (so if you made 10 calls chasing and they logged it at £20 per call, you'd pay £200 etc etc...)

    I'm sure there are conveyancing factories who will do a "no win no fee" basis though :)

    (think of it like your boss asking you to take an hours less pay for the work you do every day, all because you started a task, but then he asked you to stop doing it, so he wasn't going to pay you for it...)

    Yes, Kyresa is right.

    I assume you have a fixed quote for completing the conveyancing.

    However if your sale/purchase falls through(you pull out; the other side pulls out) you'll be charged on the basis of the time they've spent up to that point.

    Some firms (including high street solicitors if you ask) will offer a no completion no fee contract, though they'll usually charge you for disbursements (ie things they have to pay for on your behalf like searches).

    That seems quite excessive, so if the seller pulls out, and my solicitor has done 10 hours work, theyll bill me 2k? damn.

    I'd expect it to say that in abortive cases the fees would be capped - preferably at something below your fixed fee (given there's no responsibility element i.e. you can't sue them about negligence if you didn't complete your purchase).

    Normally they would charge the lower of the fixed fee, or the amount of work at the hourly rate, but check with them if you are not sure.

    Why is your solicitor going to spend 10 hours on your case. Unless you unnecessarily waste their time.

    Also the rate is for a partner. Unless you've got a very complex or high value transaction it'll likely be dealt with by a conveyancer or paralegal etc who's fees will be less.

    When we were buying we had an abortive sale and we were charge about £150.
