Outstanding Claim Settlement

Some 30 years ago, insurance settlement was made for both my parents death. Settlement cheques went to my brother, who was ill, and all documents were 'lost'.
These came to light recently - all documentation and cheques are with me.
Insurance company stated that they would have reissued cheques 6 months later, but brother had moved, and has no knowledge of any contact with them.
Insurance company have effectively said 'too long ago, no records, go away.'
Should the onus be on them to prove second cheques were issued, acknowleded and cashed !!
Any help or advice would be appreciated.

Little hope here! (Why do you say cheques were 'lost' rather than simply say lost??)

I can't see how the onus is on them to make sure the cheques were cashed, they issued settlement - so they have done what they were supposed to do.

We wouldn't automatically re-issue an un cashed cheque, we'd call the person the cheque is made out to and ask whether the address is correct before sending another cheque out.

They are correct that they possibly don't have records going that far back, as records have to be destroyed within a given timeframe.
  • Hi, thanks for comments. Insurance company say they would check address before reissue, but address changed in intervening period, and there was no follow up query from them, and no reissue(unless to the old address)
know this may be a lost cause, which is why i posted question,
    Thanks again,
