Now that legal precedent seems to have been set on Liverpool Business Park and "no stopping",
Could a person who receives a parking charge notice letter issue a claim straight away? Not waiting until the claimant - VCS or BW Legal - do or do not file a claim. Secondly does the claim state £250 or £750 or does the judge decide the amount? obviously if one was going to claim you would do it for £750.
The costs of filing a claim are listed on the above thread as
£25 filing fee. £25 hearing fee. Their costs if you lose under practice direction 27.14 (limited mostly to travel, which is not usually appropriate).

Please read the other thread you jumped in on.

No surprise, doubtful they'll risk court and possibly kill the goose that lays the golden eggs.
  • Hi Can I ask what I should put in the reason drop down for my appeal ?
I don't want to say the wrong thing and drop myself in it.

    Thanks

This is someone else's thread! We've no idea whose dropdown box you are talking about. We can't mind-read. :)

I think someone is playing games today, too many of these 'new posters on someone's thread' for one morning, to be a coincidence.

  • My partner stopped in a small car park at JLA and the camera van whizzed round and took photos thus leading to a PCN letter and fine. The letter came in my name as I am the registered keeper but in my appeal on my partners behalf (he has mental health issues) I have obviously given them his name. Now another PCN letter has come in his name and since this he has had an email rejecting my appeal. They then state that I can appeal this to the IAS.
Having just read some reports on here, it looks as though I've made a mistake by giving them his name but I had to do this as he cannot indulge in letters or emails due to his condition.
What should I do now? Appeal to the IAS? Please help as this is causing my partner anxiety and depression and making his condition worse because of the worry.

You should've appealed in your name as the Registered Keeper, then your partner need not have been involved.

What you do now is read the NEWBIES FAQ sticky thread and if you still have questions then please start a new thread.

    Thanks.

Had to do what? It had YOUR name on it and was yours to dispute and defend in court, not his... but it is now.

No to IAS, obviously, as per the NEWBIES thread advice.

  • Hi,
OK so the advice is to just ignore the chance of appealing to the IAS due to their 'Kangaroo Court' proceedings as I believe this usually gets you no where. However, I presume it doesn't do any harm to try as they can only reject it and you are still at the same situation.
If they reject it or I don't bother to appeal to them I will obviously then get another letter saying fine is now £100 not £60 etc etc.
What would then be my next step please?
