To save all the parties hassle, then write to BW and ask for copies of the pics of the car they will rely on at court.
If they send them, then you can decide. If they don't, then you can continue to ask to show a court a level of unreasonableness on BW's part.
Saves all the messing around with technical arguments. The valid ticket was either visible or it wasn't.
We already asked for the photos and they have sent them. The ticket is not visible on the pictures they have shared of the windscreen and dashboard. They also enclosed pictures of the signage, but that was dated 2015, not 2012?! At the time in 2012, we sent them a scan of the valid ticket which we had assumed must have fallen/blown off the dashboard. They replied that the ticket would not be accepted. We ignored the next few letters and it went quiet up until recently.
Based on the above, do we have any defence if it does go to court?0 -
Yes, certainly! Peel Centre is shocking re signage in 2012 - and hopefully you can also rely on 'no keeper liability' if the driver was never implied or named in your appeal and they are just pursuing the same person named on the PCN back in 2012.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

We named the driver (my wife) unfortunately, when we sent the ticket and appealed.0 -

Same as ever, try searching the forum for 'BW Legal £54' or 'Peel Centre 2012' and read all the other threads exactly like yours. All defendable - the signs were pants and the defences are strong.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
