ParkingEye/DRP - notice of intended court action
Honey9036
I've followed all the pre-existing advice on here about ignoring these letters from ParkingEye (I'm in Scotland). But the recent two letters have come from Debt Recovery Plus, and they are threatening court action (the amount due has jumped from £80 to £145!). The parking overstay happened 14 months ago. I would have expected them to have given up by now?! So I'm starting to panic.
The most recent letter states "As you've not contacted us to tell us that you're not liable for the charge, we've taken this to mean that you agree you're liable for it". What should I do?
The original letter from ParkingEye had a photograph of my car entering and exiting the car park. Is the grainy quality of the photo of a person in the driver seat enough for them to think they can proceed with court action? I stupidly threw that letter out, so I no longer have the photo to see whether it's clearly me (or if it could be deemed not clear enough to conclusively identify the driver). They haven't mentioned the photo at all. I'm only mentioning it because I wondered if that's why they are still pursuing this after 14 months.
In their letter, they mention the Supreme Court ruling of November 2015, and that the parking charge is lawful.
Please help! Thanks in advance.

hold your stand , PE do not bother with the hassle in scootland, they CANNOT prove who was driving
please edit your post to read ". Is the grainy quality of the photo of A PERSON in the driver seat enough for them to think they can proceed with court action?0 -
no need for any help at all, continue to IGNORE
DRP are not threatening court at all (read the letter again) , they are saying that if you fail to pay them they will recommend that PE issue a court case (totally different scenario) - they have 5 years in Scotland to do this (so less than 2 years is nothing)
no keeper liability in Scotland , so if PE dont know the drivers details , its all empty threats from their sub-contractor
read the DRP advice again (newbies sticky thread) , then ignore ANY and ALL debt collectors , regardless
Beavis was the driver , admitted it and was taken to an english court , he lost (3 times)
no POFA2012 in Scotland
so to repeat, DRP cannot take you , me or the queen to court , you read it wrong
edit post #1 so that nobody knows who was driving (they read forums)

Thank you both for your excellent advice. You've really set my mind at rest. I apologise for giving in to my worries and not fully putting my faith in the advice already provided in these forums. I guess I was just panicking and not thinking rationally enough. Thanks again. x0

expect more letters from different companies , but there is a new game , its called "snap" , as in look at the addresses on the letter footer0 -

Nothing to worry about in Scotland & NI. Always always complain to the retailer/landowner, though. Complaints get these firms kicked out.Awilliams1 wrote: »I'm on the same boat. I gave them a phone. They denied having anything to do with the car park.0

Them being one retailer of several? So, the landowner/site agent would be the party which contracted the PPC.
And this sort of complaint isn't something to do by phone...as long as people in Scotland remember NEVER to say who was driving, even in complaints.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
